PSIK in cooperation with Invest Europe is organizing an educational seminar devoted to arbitration in private equity transactions. It will be held on 20 March 2019 at 9:30 in Warsaw.
This seminar is open to members of all local national PE/VC associations, members are invited to attend the seminar for free.
Goal: The aim of the seminar is to highlight arbitration issues in private equity transactions, and
get private equity practitioners educated about and acquainted with the spirit and practice of
arbitration and how it differs from court proceedings.
Concept: The seminar will focus on two cases involving a pre-closing and a post-closing dispute.
Private equity professionals and their M&A transaction lawyers will act as claimants and
respondents in each case, which will be presided over by an arbitration judge. The cases will
highlight real-life issues that are relevant to typical transaction work of private equity firms. The
cases will be distributed to confirmed participants in the seminar in advance.
Pre-closing dispute will be resolved by a sole arbitrator – Beata Gessel-Kalinowska vel Kalisz. Beata
is a leading authority on arbitration matters and is a member of the ICC International Court of
Arbitration, and also the founder of one of the leading Polish law firms involved in private equity
and M&A deal.
Post-closing dispute will be resolved by a sole arbitrator – Felipe Aragón Barrero. Felipe
represents a young generation of arbitration practitioners. He has participated in numerous
arbitration proceedings conducted under the arbitration rules of ICC, ICSID, UNCITRAL and CAM.
